Gas Safety Certificates
Gas safety certificates are recorded information in the form of a certificate which confirms that a test on all gas appliances in a rental property has been carried out. Gas Safety Certificates are required by law for rental properties on an annual basis and help maintain a safe home. A gas safety certificate is proof of gas works and inspections made in the property. This certificate must be renewed every 12 months and a copy of the certificate must also be given to tenants.
Who needs a Gas Safety?
Gas Safety Certificates are records that demonstrate which gas appliances are safe. It is a legal requirement for UK Landlords to maintain gas safety certificates, since 1998 Gas Installation and Use Regulations were issued. Landlords must renew gas certificates annually. If a Landlord fails to do so, there will be consequences against them by the law. Certificates have to be completed by a qualified gas engineer, registered with the Gas Safe scheme.
What if an appliance fails on inspection?
If a gas appliance/ installation has any problems and fails the test, the registered and qualified engineer may either leave a warning notice for the landlord/tenant or in some cases disconnect the appliance or request that the gas company cut off the gas supply to the property? We request that in such cases our gas engineers let us know immediately if they have had to carry out such works at the property for us to inform you the landlord as soon as possible.
The landlord or us as the agent will need to elect a gas safe engineer to remedy the fault by carrying out any works required or have the appliance replaced before reconnecting it and then conducting a new gas safety test and issue a new certificate. The certificate can only be issued once all of the gas appliances have passed the test.
If the gas engineer notices any problems the landlord has to have them repaired by law. If a landlord fails to carry out any remedial work on the appliance or fails to provide a gas safety certificate they are committing a criminal offence. The “Health and Safety executive” can then prosecute. This can be anything from a fine to imprisonment.
